Thread starter Eclipse Start date Feb 20, Eclipse Registered Users C Feb 20, I decide to write this "case study" to share my experience and lessons so other people can prepare their applications better before they submit it, as well as take advantage of any inputs people can offer me.
My application: 1. Claimed 3 criteria - scholarly publications, original contribution, judge of work of others.Virtual piano
I wrote my cover letter like a research paper I mean the chapter - section structure of the letter, language is layman of course using latex, even with a table of content. I believe it's quite well written judged in terms of scientific writingbut apparently it didn't click with the adjudicator.
Used exact phrase in the law for the 3 criteria I claimed, and emphasized which criteria I was claiming in a few places including the beginning and conclusion of the petition letter.
Content of RFE: I believe this is typical of the letters many received, which was slightly edited from a common template that people at TSC use.

Submit evidence of the media coverage the events received, evidence of participation used in determining who is eligible to participate, and any other evidence that the events are distinguished. If renowned individuals participated in the events, submit evidence of those individuals' renown and acclaim.
Please respond in detail and submit evidence in support of your response. These were published in premire scientific journals which are certainly "major. Since it was clear they don't consider other people's citation to and comments on the applicant's papers evidence of "published material about the alien in major media. Not sure if I should respond to this point and touch the "published material about the alien" at all.
For example, how has your work benefited your profession or other interests?
Yet they don't want me to use this piece of evidence! Include evidence of the criteria for membership. While the NIW petition is often thought to require an advanced degree, that is not necessarily the case. For example, while this client was pursuing his PhD degree, the highest degree he had already earned was a BS degree. Total citations; one publication has 60, the other two have 13 and I have received an RFE. It states that, I have met two of the three criteria. The criteria I did not meet is :. I did provide this as well. In spite of providing these, I was issued RFE. Is this considered to be a normal RFE or something which is difficult to convince the I. I plan to show my updated citation record which has now increased to The 60 citations improved to I plan to highlight my significance of research in the original recommendation letters in the response to RFE.
I plan to remind the I. O that I already provided the patent where my paper was referenced. How does the evidences sound? Is there any other specific evidences that I need to provide? Do I produce more recommendation letters and doing so would it be helpful? I have an upcoming conference in August and will it be helpful if I provide conference presentation as another evidence?
You can explain that this number of citations is caused by the fact that your research is recent if it is and that it takes time for others to write papers to cite your work. Instead, focus on the testimonies of other researchers. Please be aware of precise wording in the recommendation letters.
If they do, highlight them. Just to let you know, my has been denied. Submitted the response on September 15th and received the Denial notice on October I did submit 3 additional letters of recommendation and updated google scholar profile with citations, but looks like the officer was predisposed to deny the case.
Good luck Nam with your application, not sure what I can advise you but withdrawal could definitely be considered if your case is with Nebraska.

My case went to a difficult officer in EB1a pp and got a RFE for major significance despite having over citations, and several peer reviewed journal articles and editorial board members.
My attorney is not confident that it will get approved if we take time and reply to RFE. My current J-1 is ending on Sept.
I haven't applied I so far. In this case, I should have enough time to find either a H1b sponsor or get EAD way before my I goes for processing. In case I get EAD, I will have more time and chance to join new job or to improve the citations or gather more evidence to show major significance.
Eb1-A - time taken after filing the RFE
